Probate, or successions as the process is called in Louisiana, is not something to fear. In most cases, if the succession is relatively debt free, the succession may be completed in days and be relatively inexpensive.

A succession is the transmission of the estate of a deceased to his successors (legatees and heirs) who have the right to take possession of the estate after complying with the applicable provisions of the law.

Testate and Intestate Successions

There are two sorts of successions: testate and intestate. A succession is testate if the deceased person, the decedent, left a will. A person who inherits under a will is called a legatee. The property in a testate succession is conveyed to the legatees by the court approving the filing of the will, which is called the probate of the will. Once the will is probated, the legatees merely petition to the court to be put in possession of the succession property in accordance with the directives of the will.

Conversely, a succession is intestate if the decedent left no valid will. If the person inherits under the law of intestate successions that person is called an heir. Heirs are placed in possession with the property of the succession by petitioning the court to be placed in possession in accordance with the laws of intestate successions.

Successions can also be divided into those that are placed under the authority of a court approved administrator and those for which no administration is required. If no administrator is required, the heir or legatees of a succession may be placed into possession of the succession property merely by petitioning to the court for a judgment of possession. These types of successions are the type that may be completed rather quickly and inexpensively.

Successions under administration are necessarily more complex than a succession not placed under administration, but they need not be burdensome or expensive.
